Equipment Rental Agreement
This agreement is between Big Time Equipment Rentals, LLC (BTER) and the customer identified in the reservation. The reservation, selected equipment, rental schedule, delivery address, price, and accepted Cancellation and Refund Policy are incorporated into this agreement.
Payment and rental period
Payment in full is required to confirm a reservation. The customer may possess the equipment only during the rental period shown in the reservation. A daily rental includes up to 8 operating hours and a weekly rental includes up to 40 operating hours. Multi-week rentals include the corresponding weekly operating-hour allowance for each rental week. Any different operating-hour allowance stated in the reservation controls. Meter usage exceeding the applicable allowance is charged for each additional operating hour or portion of an hour at one-eighth (1/8) of the applicable daily rental rate multiplied by 1.5. Excess-usage charges are capped at the applicable daily rental rate for each additional block of up to eight (8) operating hours.
Extensions. Rental extensions are not automatic and must be approved by BTER before the scheduled end of the rental period. Approved extensions of less than one additional day are charged for each additional hour or portion of an hour that the customer retains possession of the equipment beyond the scheduled rental end time, at an hourly extension rate equal to one-eighth (1/8) of the applicable daily rental rate multiplied by 1.5. Extension charges are capped at the applicable daily rental rate for each additional day. Once extension charges reach the applicable daily rental rate, the customer will be charged the daily rental rate, which permits possession for up to one additional day and includes up to eight (8) additional operating hours. BTER may decline an extension because of an existing reservation, equipment availability, or other operational requirements. Continued possession or use after the scheduled rental period without BTER’s approval does not constitute an approved extension and may result in additional charges and recovery of the equipment.
Additional payment authorization. The customer authorizes BTER to charge the payment method associated with the reservation for amounts properly due under this agreement, including approved extensions and applicable meter, fuel, cleaning, late-possession, delivery, pickup, recovery, damage, loss, or other disclosed charges. BTER will maintain reasonable records supporting post-rental charges and will provide documentation upon reasonable request.
Authorized and safe operation
The customer is responsible for ensuring that every operator is legally permitted, physically capable, properly trained, and familiar with the manufacturer’s instructions and safety requirements. The customer may permit only persons under the customer’s authorization and control who satisfy these requirements to operate the equipment. Equipment may be used only for its intended purpose and in compliance with all laws. The customer may not subrent the equipment, remove safety devices, overload it, or permit unsafe, reckless, or impaired operation.
The equipment may not be removed from the delivery address, relocated to another job site, transported, towed, loaded onto another vehicle or trailer, or otherwise moved from the approved location without BTER’s prior written approval. Customer pickup or customer transportation of BTER equipment is prohibited unless specifically authorized by BTER.
Equipment may not be used to carry or elevate persons unless specifically designed and approved for that purpose and may not be operated beyond the manufacturer’s rated capacities, limitations, or approved uses.
Delivery, site access, and utilities
The customer must provide accurate delivery information and safe, lawful access for delivery and pickup. The customer is responsible for site conditions, permissions, and locating underground or overhead utilities before work begins. Unless separately agreed in writing, BTER does not identify, mark, locate, or verify underground or overhead utilities for the customer. BTER may refuse or stop delivery or use when conditions are unsafe or unlawful.
If delivery or pickup cannot reasonably be completed because of inaccurate information, unsafe or inaccessible site conditions, locked or restricted access, lack of required authorization or assistance, or other circumstances within the customer’s control, the customer remains responsible for applicable delivery, pickup, waiting, redelivery, recovery, and additional rental charges.
Inspection, care, and return
The customer must inspect the equipment upon delivery and report any visible damage, missing items, or operating concerns before use or as soon as reasonably discovered. BTER may photograph or otherwise document the equipment, attachments, fuel level, meter readings, and condition at delivery, during service when necessary, and at pickup or return.
The customer must protect the equipment from theft, vandalism, misuse, flooding, submersion, preventable weather-related damage, and other avoidable loss; perform ordinary checks described by BTER or the manufacturer; and return it on time in substantially the same condition, ordinary wear excepted. No repair or alteration may be made without BTER’s approval.
Fuel, cleaning, and other charges
The equipment will be delivered with a full fuel tank. The customer is responsible for fuel consumed during the rental. After pickup, BTER will restore the tank to full and charge the documented fuel cost plus a $20 refueling service fee. Excessive cleaning, additional meter usage, late possession, failed delivery or pickup, recovery, and other applicable charges will be assessed according to the rates or calculation methods disclosed in the reservation, checkout process, or applicable fee schedule incorporated into this agreement.
Ordinary dirt consistent with normal use is not considered excessive cleaning. Excessive cleaning may include substantial mud buildup, concrete, asphalt, paint, grease, hazardous materials, waste, debris, or other contamination requiring cleaning beyond BTER’s ordinary post-rental preparation.
Damage, loss, and additional charges
From delivery until confirmed pickup, the customer is responsible for loss, theft, misuse, avoidable damage, excessive cleaning, missing parts, unauthorized repairs, and other charges caused by a breach of this agreement. Charges will be based on reasonable actual costs and documented losses, including, when applicable, diagnosis, parts, labor, repair, replacement, towing, recovery, environmental cleanup, and replacement of missing equipment, attachments, accessories, or components, to the extent permitted by law. Ordinary wear and damage caused solely by BTER are excluded.
Customer responsibility may include damage to tires, tracks, glass, hydraulic hoses, attachments, buckets, couplers, cutting edges, keys, controls, safety devices, and other equipment components when the damage results from misuse, abuse, impact, improper operation, unauthorized modification, or another condition for which the customer is responsible. Normal wear, ordinary consumption, and failures not caused by the customer are excluded.
Theft and major loss
Theft, suspected theft, vandalism, fire, collision, rollover, submersion, or other material loss or damage must be reported to BTER immediately. The customer must promptly notify law enforcement when reasonably appropriate and cooperate with BTER, its insurers, and law enforcement in documenting and investigating the incident.
Breakdowns and service
If equipment malfunctions or appears unsafe, stop using it, secure it, and contact BTER immediately. Do not attempt repairs unless authorized. Depending on availability and the circumstances, BTER may repair or replace the equipment, reschedule the rental, or refund the affected unused rental time. These remedies do not apply to downtime resulting from misuse, abuse, improper operation, accident, failure to perform required customer checks, unauthorized repair, continued operation after a material warning or malfunction, or another condition for which the customer is responsible. The customer is responsible for additional damage caused by continuing to operate equipment after it becomes unsafe, experiences a material malfunction, overheats, displays a material warning condition, or reasonably should have been removed from service. BTER is not responsible for indirect or consequential business losses to the extent permitted by law.
Cancellation
The Cancellation and Refund Policy accepted at checkout controls customer-requested cancellations. A reservation is not canceled until BTER confirms the request.
Electronic acceptance and governing law
Checking the acceptance box and continuing to payment constitutes the customer’s electronic signature. BTER may retain the accepted document versions, acceptance time, reservation information, and payment record as evidence of agreement. Kansas law governs this agreement, without limiting any right that cannot legally be waived. If one provision is unenforceable, the remaining provisions remain effective.
